Last updated: DATE

1. Acceptance of Terms

These Terms of Use (the “Terms”) constitute a contract between you (“the User”) and Maison Trinitaire (the “Company,” “we,” “us,” or “our”). They govern your access to and use of any website, platform, client portal, CRM, or digital tool operated by the Company (the “Website”), including any content, information, product, or service made available through it.

By accessing the Website, you agree to be bound by the Terms in effect at that time and confirm that you have the legal capacity to enter into such a contract, either on your own behalf or on behalf of a legal entity you represent. If you do not accept these Terms, you are not authorized to use the Website.

2. Intellectual Property

All content displayed on or made accessible through the Website—including, without limitation: text, visuals, files, interfaces, databases, source code, web applications, digital tools, elements generated by artificial intelligence (“AI Tools” and “AI Content”), trademarks, trade names, and logos (collectively, the “Content”)—is protected by Canadian and international intellectual property laws.

Unless otherwise indicated, the Company retains all rights, title, and interest in the Content. No ownership rights are transferred to the User through access to or use of the Website.

3. Limited License

The Company grants the User a personal, non-exclusive, non-transferable, and revocable license to access the Website and use its features for internal, personal, and non-commercial purposes, in accordance with these Terms.

Any other use—including commercial, automated, systematic, or large-scale use (scraping, duplication, republishing, transmission, etc.)—is strictly prohibited without the Company’s prior written consent.

4. Artificial Intelligence Tools

The Website may include tools powered by artificial intelligence technologies developed or integrated by the Company. AI Content generated through these tools is provided for informational purposes only and without any guarantee of reliability, accuracy, or compliance with regulatory or professional standards.

The User is solely responsible for verifying any AI Content before use, and the Company assumes no liability for any consequences arising from its use.

5. Prohibited Conduct

The User agrees not to:

  • misuse or copy the Content for commercial purposes;

  • disrupt, compromise, or interfere with the security, integrity, or functionality of the Website;

  • access any data, system, or infrastructure of the Company without authorization;

  • publish, transmit, or share illegal, defamatory, offensive, or rights-infringing content through our forms, interfaces, or interactive modules;

  • attempt to collect personal information from other users without consent;

  • use our services for fraudulent purposes, spam, or unauthorized mass communications.

The Company reserves the right to suspend access to its services without notice in the event of a violation of these Terms.

6. Modifications

Maison Trinitaire may update or modify these Terms at any time. If a significant change is made, a notice may be posted on the Website or sent by email. Continued use of the Website after such modifications constitute acceptance of the updated Terms.

7. External Links

The Website may contain hyperlinks to external third-party sites. The Company assumes no responsibility for the content, practices, or security of these external sites. Access to such sites is at the User’s own risk.

8. Trademarks

The names, logos, trademarks, and visuals displayed on the Website are the property of the Company or their respective owners. Any unauthorized use is strictly prohibited.

9. Protection of Personal Information

Maison Trinitaire collects and processes personal information in accordance with its Privacy Policy, Canada’s Anti-Spam Legislation (CASL), and applicable data protection laws.

The User may contact us at any time to exercise their rights of access, correction, or deletion of their personal data. The Company will never share your information with third parties without your explicit consent.

By checking the appropriate boxes in our forms, you consent to Maison Trinitaire collecting and using your personal information (phone number, email address) to send you text messages or emails according to your preferences.

10. Contests and Campaigns

Any contest or promotional campaign run by the Company through the Website is governed by separate rules available on the dedicated pages.

11. Limitation of Liability

The Company makes every reasonable effort to ensure the accuracy and availability of the Website but does not guarantee that it will be error-free, uninterrupted, or free from vulnerabilities.

UNDER NO CIRCUMSTANCES SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES ARISING FROM THE USE OF THE WEBSITE OR THE CONTENT, INCLUDING LOSS OF DATA, FINANCIAL LOSS, OR BUSINESS INTERRUPTION.

12. Indemnification

You agree to indemnify the Company for any loss, claim, damage, cost, or expense (including legal fees) resulting from your use of the Website or your violation of these Terms.

13. Termination

The Company may suspend or terminate your access to the Website at any time, without notice, in the event of actual or suspected violation of these Terms. Certain obligations—such as intellectual property rights and limitations of liability—survive termination.

15. Accessibility

The Company is committed to making the Website accessible to individuals with functional limitations. If you experience difficulty accessing certain features, please contact us at [email protected] so that we may provide a reasonable solution.

16. Subcontractors and Third-Party Services

The Company may use suppliers or subcontractors to provide certain services (hosting, data analysis, cloud services, AI, etc.). These entities only access data as necessary to perform their services and are required to comply with strict confidentiality and security obligations.

Mobile operators are not responsible for delayed or undelivered messages.

17. Export and Data Control

The User acknowledges that certain tools, services, or Content may be subject to export control laws (e.g., Canadian or U.S. laws). It is the User’s responsibility to ensure that their use of the Website complies with applicable laws in their jurisdiction.

18. Entire Agreement and Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between the Company and the User regarding use of the Website.
